Terms of Service

1. Introduction

Welcome to PokePriceTracker! These Terms of Service ("Terms") govern your access to and use of the PokePriceTracker website at pokemonpricetracker.com, including any content, functionality, and services offered on or through the website (collectively, the "Service").

By using our Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You must be at least 13 years old to use our Service. By using our Service, you represent and warrant that you are at least 13 years old and that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.

3. Account Registration

When you create an account with us, you must provide accurate, complete, and up-to-date information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription Services and Payments

PokePriceTracker offers both free and paid subscription services. By subscribing to a paid service, you agree to pay the subscription fees indicated for your selected plan. Subscription fees are billed in advance on a recurring basis according to the billing cycle you select.

You authorize us to charge your designated payment method for all subscription fees incurred by your account. If your payment method fails or your account is past due, we may suspend or terminate your access to the paid services.

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, your subscription will remain active until the end of your current billing period.

Refund Policy: All sales are final. We do not offer refunds for subscription fees, regardless of usage or satisfaction. Please review our features and pricing carefully before subscribing.

5. API Usage

Our API services are subject to additional terms and limitations based on your subscription level. API usage is monitored and rate-limited to ensure fair use and service stability.

You agree to:

  • Not exceed the API rate limits associated with your subscription plan
  • Not attempt to circumvent any security measures or access limitations
  • Properly authenticate all API requests using your API key
  • Not use the API or PokePriceTracker Data for commercial purposes without an active Business or Enterprise subscription (see Section 6 for details)
  • Not resell, sublicense, or redistribute raw API data as a standalone data product or service (see Section 6 for details)
  • Comply with any additional API terms provided in our API documentation

6. Data Usage & Commercial Restrictions

All pricing data, card information, market analytics, and other data provided through the Service and API (collectively, "PokePriceTracker Data") remain the property of PokePriceTracker.

Permitted Uses (All Plans)

On any plan, including the Free tier, you may use PokePriceTracker Data for personal and non-commercial purposes, including:

  • Personal collection tracking, valuation, and portfolio management
  • Hobby projects and free, non-revenue-generating applications and tools
  • Academic research and educational projects
  • Development, testing, and evaluation of an application prior to its commercial launch

Commercial Use (Business and Enterprise Plans Only)

Using PokePriceTracker Data for any commercial purpose requires an active Business or Enterprise subscription. Commercial use includes, but is not limited to:

  • Building applications, websites, bots, tools, or services that generate revenue (through subscriptions, advertising, one-time sales, paid features, or otherwise)
  • Powering online shops, marketplaces, or e-commerce platforms with pricing information
  • Internal business analytics, reporting, and decision-making
  • Training artificial intelligence or machine learning models for commercial products
  • Displaying card prices, trends, or market data within a commercial product or service

Prohibited Use: Data Resale (All Plans)

Regardless of your subscription plan — including Business and Enterprise — you may not resell, sublicense, syndicate, or redistribute the raw data itself as a standalone product or data service. No subscription tier grants data resale rights. Specifically, you may not:

  • Use our API to power your own competing API that sells or provides the same pricing data to third parties
  • Create and sell bulk datasets, data feeds, or database exports sourced from our API
  • Operate a data brokerage or syndication service that redistributes PokePriceTracker Data
  • Offer PokePriceTracker Data as a service, whether for free or for compensation, in a manner that substitutes for or competes with the PokePriceTracker API

In plain terms: use the data to build things on the appropriate plan — do not repackage and sell the data itself.

Caching, Storage & Your Own Applications

You may store and cache PokePriceTracker Data in your own systems and serve it to the end users of your own application, on the plan appropriate to your use. Serving your own first-party clients — for example a mobile app, front end, or internal tool that consumes your own backend — is not considered operating a competing API, provided that interface exists to power your own product and is not made available to third parties as a data source.

This permission does not extend to exposing your stored copy to third parties, publishing it as an API or feed, or transferring the stored dataset to anyone else. If another party could use your product in place of a PokePriceTracker subscription to obtain the data itself, that is redistribution and is prohibited under this Section.

Cached data should be refreshed on a reasonable schedule so that end users are not shown materially stale pricing.

Data Sources & Third-Party Rights

PokePriceTracker publishes what its data covers but does not disclose its collection methods, sourcing arrangements, or infrastructure. PokePriceTracker is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, TCGplayer, eBay, Professional Sports Authenticator (PSA), or any other third party, and claims no partnership with or authorization from any such party. You are solely responsible for your own compliance obligations in your jurisdiction arising from your use of the Service. Nothing in these Terms constitutes a grant of rights in any third-party content, trademark, or database, and PokePriceTracker provides no indemnification against third-party claims (see Sections 10, 11 and 12).

Enforcement

Violation of the data resale restriction, or commercial use of the Service without an active Business or Enterprise subscription, may result in immediate revocation of your API key and termination of your account. PokePriceTracker reserves the right to pursue any and all legal remedies available.

Enterprise & Data Licensing

If your use case requires a data resale or redistribution license, please contact us at pokepricetracker@proton.me to discuss an enterprise agreement.

7. User Content

Our Service may allow you to upload, store, or share content such as card collection data, comments, and feedback ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving our Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate the rights of any third party
  • Your User Content complies with these Terms and applicable law

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violating or infringing upon the rights of others, including intellectual property rights
  • Attempting to gain unauthorized access to the Service or other users' accounts
  • Transmitting any material that contains viruses, Trojan horses, worms, or other harmful code
  • Scraping, data mining, or otherwise collecting data from the Service without our prior written consent
  • Using the Service in a manner that could damage, disable, overburden, or impair the Service
  • Impersonating another person or misrepresenting your affiliation with any person or entity

9. Intellectual Property

The Service and its original content, features, and functionality are owned by PokePriceTracker and are protected by copyright, trademark, and other intellectual property laws. The PokePriceTracker name and logo are trademarks of PokePriceTracker.

Pokémon and Pokémon character names are trademarks of Nintendo. PokePriceTracker is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, or any of their affiliates.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability

IN NO EVENT SHALL POKEPRICETRACKER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless PokePriceTracker, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
